These Terms of Use govern your access to and use of www.freeup-storage.com (the "website"), including browsing the site, viewing facility information, submitting forms, making reservations, and using any online tools or features available on the site. By accessing or using this website, you agree to be bound by these Terms of Use. If you do not agree, please do not use this website.
This website is operated by FreeUp Storage, LLC. References to "we," "us," "our," and "FreeUp Storage" in these Terms refer to FreeUp Storage, LLC. The term "you" refers to the customer visiting the website, mobile site, and/or booking a self-storage unit reservation through us on this website, via phone, or through our agents.
These Terms of Use apply only to the use of this website. They do not govern the rental of storage units or any other services provided at FreeUp Storage facilities. The rental of any storage unit is governed by a separate Rental Agreement, which you will be asked to review and sign prior to or at move-in. In the event of any conflict between these Terms of Use and your Rental Agreement, the Rental Agreement will control with respect to your storage rental.

We reserve the right at any time, at our sole discretion, to change or otherwise modify these Terms of Use without prior notice. Your continued access or use of this website signifies your acceptance of the updated or modified Terms. Be sure to return to this page periodically to review the most current version.
1. Use of the Website
As a condition of your use of this website, you warrant that:

- You possess the legal authority to create a binding legal obligation

- You will only use this website to make legitimate self-storage unit reservations for yourself or for another person for whom you are legally authorized to act
- You represent and warrant that your use of this website does not violate any applicable law, regulation, contractual restriction, or third-party right.
- All information supplied by you on this website is true, accurate, current, and complete
- If you make a reservation or otherwise transact online with FreeUp Storage, LLC, you will safeguard your login information and will be completely responsible for any login by anyone other than yourself
We retain the right, at our sole discretion, to deny anyone access to this website and the services we offer, at any time and for any reason, including for violation of these Terms of Use.
2. Use of the Mobile Site
FreeUp Storage, LLC's mobile site is provided in the same way, for the same purposes, and under the same conditions as the website. By accessing or using the mobile site in any manner, you agree to be bound by these Terms of Use. If you do not accept all of these terms and conditions, please do not use the mobile site.
3. Pricing, Promotions, and Availability
Prices, promotions, and unit availability displayed on this website are subject to change without notice and may vary by location. Online rates and specials are not guaranteed until confirmed in writing as part of a signed Rental Agreement. We reserve the right to modify, discontinue, or expire any promotion at any time without prior notice.
Unit sizes, features, amenities, and available services may vary by location. Dimensions listed on this website are approximate. Please contact your local FreeUp Storage facility to confirm availability, unit dimensions, and amenities before making a reservation.
4. Acceptable Use and Prohibited Activities
The content and information on this website, including price and availability of self-storage units, as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. While you may make limited copies of your self-storage reservation and related documents for personal use, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or units obtained from or through this website. You may not use this website to test, probe, scan, or assess the vulnerability of any system, network, or security mechanism associated with the website.
Additionally, you agree not to:
- Use this website or its contents for any commercial purpose
- Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand
- Access, monitor, or copy any content or information of this website using any robot, spider, scraper, or other automated means or any manual process for any purpose without our express written permission
- Violate the restrictions in any robot exclusion headers on this website or bypass or circumvent other measures employed to prevent or limit access to this website
- Take any action that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure
- Deep-link to any portion of this website for any purpose without our express written permission

If you create an account or login credentials to access features on this website or any linked tenant portal, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately if you believe your account has been accessed without your authorization. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
6. Third-Party Platforms and Supplier Rules
Some features of this website, including online reservations, account management, and payment processing, may be provided through third-party platforms. We may utilize third-party service providers to facilitate reservations, account management, communications, payment processing, analytics, and other website functionality. Separate terms and conditions will apply to any reservation and rental of a self-storage unit that you select. You agree to abide by the terms and conditions of rental imposed by any self-storage facility with which you elect to deal, including payment of all amounts when due and compliance with all applicable rules and restrictions. Any violation of such rules and restrictions may result in cancellation of your reservation, denial of access to the applicable unit, forfeiture of monies paid, or charges to your account for costs incurred as a result of such violation.
7. Use of Digital Call Records
FreeUp Storage, LLC uses technology that records incoming and outgoing telephone calls for quality assurance, customer service, and data tracking purposes. A voice alert is played at the beginning of each recorded call. By continuing the call after the recording notification, you expressly agree and acknowledge that:
- Our employees, contractors, officers, agents, and authorized representatives may listen to recorded calls on our behalf
- Recording, transcribing, monitoring, analyzing, and archiving calls may include personal and non-personal data related to such calls
We represent and warrant that we have established proper procedures to protect the privacy of all callers in connection with call recording services and that we fully comply with all applicable laws, regulations, and governmental guidelines.

All content on this website, including but not limited to text, images, logos, graphics, icons, photographs, audio clips, and other materials, is owned by or licensed to FreeUp Storage, LLC and is protected by applicable copyright, trademark, and other intellectual property laws. FreeUp Storage, LLC trademarks, service marks, graphics, and logos used in connection with this website are trademarks or registered trademarks of FreeUp Storage, LLC or its licensors. Other trademarks and logos used in connection with this website may be the trademarks of other third parties.
Your use of this website grants you no right or license to reproduce or otherwise use any FreeUp Storage, LLC trademarks or third-party trademarks. You may view, download, and print content from this website solely for your personal, non-commercial use, provided you do not modify the content and you retain all copyright and other proprietary notices.

14. Governing Law and Venue
These Terms of Use are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms of Use or your use of this website shall be resolved exclusively in the state or federal courts located in Jefferson County, Colorado, except where prohibited by applicable law or where arbitration applies under Section 15. You consent to the personal jurisdiction of those courts.

The following Colorado statutes and legal frameworks apply to your use of this website and your relationship with FreeUp Storage, LLC:
Colorado Consumer Protection Act (C.R.S. 6-1-101 et seq.): Prohibits deceptive trade practices. FreeUp Storage, LLC is committed to honest and transparent communication regarding pricing, availability, promotions, and services.
Colorado Uniform Consumer Credit Code (C.R.S. 5-1-101 et seq.): Governs certain credit transactions and consumer protections related to billing and payment practices.

Colorado Self-Storage Lien Law (C.R.S. 38-21.5-101 et seq.): Governs the rights and obligations of self-storage operators and occupants in Colorado, including lien rights, notice requirements, and auction procedures. This law applies to your storage rental relationship and is addressed in your separate Rental Agreement. It is not governed by these Terms of Use.
Colorado Uniform Commercial Code (C.R.S. Title 4): May apply to certain commercial transactions conducted through or in connection with this website.
Dispute Resolution: Before initiating any formal legal proceeding, we encourage you to contact us directly at information@freeupstorage.com to attempt to resolve any dispute informally. We will make reasonable efforts to address your concerns promptly and in good faith.
15. Arbitration Agreement and Class Action Waiver
Please read this section carefully. It affects your legal rights and requires individual arbitration of most disputes rather than court proceedings or class actions.
Agreement to Arbitrate
Except as provided below, you and FreeUp Storage, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use, your use of this website, or any services offered through this website (collectively, "Disputes") will be resolved exclusively through binding individual arbitration rather than in court. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. 1 et seq.) and, where applicable, the Colorado Uniform Arbitration Act (C.R.S. 13-22-201 et seq.).
Arbitration Process
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration will be conducted by a single neutral arbitrator. Unless you and FreeUp Storage, LLC agree otherwise, the arbitration will take place in Jefferson County, Colorado, or at your election, via telephone or videoconference. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Costs and Fees
Filing fees and arbitrator compensation will be allocated in accordance with the AAA Consumer Arbitration Rules. If you cannot afford the filing fee, you may request that FreeUp Storage, LLC pay it on your behalf, and we will consider such requests in good faith. Each party will bear its own attorneys' fees unless the arbitrator finds that a claim or defense was brought in bad faith or for an improper purpose.
Class Action Waiver
You and FreeUp Storage, LLC each agree that any Dispute will be resolved only on an individual basis and not as part of any class, collective, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class action waiver is found to be unenforceable, the entire arbitration agreement in this section will be null and void.
Exceptions to Arbitration
Either party may bring an individual action in small claims court in Jefferson County, Colorado, provided the claim qualifies and remains in small claims court. Either party may also seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights, confidential information, or other proprietary rights. Claims arising directly from your storage unit Rental Agreement are governed by that agreement and are not subject to this arbitration provision.
Opt-Out Right
You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms of Use by sending written notice to FreeUp Storage, LLC at information@freeupstorage.com with the subject line "Arbitration Opt-Out." Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration. If you opt out, any Disputes will be resolved in the state or federal courts located in Jefferson County, Colorado, as set forth in Section 14.
Severability
If any part of this arbitration agreement other than the class action waiver is found to be invalid or unenforceable, that part will be severed and the remaining provisions will continue in full force and effect.
Notwithstanding the foregoing, nothing in this section shall prohibit either party from reporting concerns to federal, state, or local government agencies.
16. Force Majeure
FreeUp Storage, LLC shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, labor disputes, governmental actions, internet or telecommunications failures, cyberattacks, power outages, or failures of third-party service providers.
17. Electronic Signatures
By using this website, you consent to receive communications electronically and agree that electronic records, notices, disclosures, and signatures satisfy any legal requirement that such communications be in writing.
18. Changes to These Terms
We may update these Terms of Use at any time. When we make changes, we will post the updated Terms on this page and update the "Last Updated" date above. Your continued use of this website after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
