FreeUp Storage, LLC ("FreeUp Storage," "we," "us," or "our") places a high priority on maintaining the privacy and confidentiality of the information that you provide to us. This Policy applies to information we collect online (including through our website and mobile services), by phone, by email, via forms, and offline in the course of our business operations.

This website uses integrated software components and services provided by Cubby Enterprises, Inc. for storage unit management, reservations, and customer communications. 1. Information We Obtain

We are committed to protecting personal information and handling it transparently and lawfully. We collect and use personal information to operate our business, provide and improve our services, communicate with you, and meet legal and contractual obligations.

We may obtain personal information directly from you, from publicly available sources, from third parties (such as lead providers, marketing partners, and analytics providers), and automatically through your use of our online services. Categories of personal information we may collect include:

Identifiers and contact details: name, alias, postal address, email address, telephone number, online identifiers, IP address, and account credentials.

Storage and account information: unit preferences, rental history, account status, access credentials, and related reservation and move-in details.

Financial and payment information: payment card information, billing address, payment history, and transaction records.

Government ID and verification data: driver's license or other government-issued ID, where required for identity verification.

Communications and preferences: inquiries, call recordings (where permitted by law), emails, text messages, chat transcripts, survey responses, marketing preferences, and consent records.

Online and device data: log files, cookie identifiers, analytics data, pages viewed, links clicked, timestamps, referrer URLs, approximate location derived from IP address, and similar usage information.

Inferences: profiles and preferences we infer from the information above, such as communication preferences and service interests.

If you provide information about other individuals (such as an emergency contact or authorized account user), you represent that you have authority to do so and to permit us to use that information in accordance with this Policy.

2. How We Use Personal Information

Business operations and transactions: to evaluate reservation requests; manage accounts; conduct due diligence; arrange move-ins and move-outs; manage billing; maintain business records; and provide our services.

Customer service and communications: to respond to inquiries; schedule appointments; provide updates; send administrative information; and manage customer relationships.

Marketing and personalization: to send promotional communications; deliver targeted advertising; personalize content and offers; and administer surveys and referral programs. You may opt out of marketing as described in Section 9.

Compliance and risk management: to verify identity; prevent fraud and unlawful activity; comply with applicable laws, court orders, and regulatory requirements; and enforce our agreements.

Analytics and improvement: to operate, maintain, secure, and improve our website, products, and services; develop new features; and conduct research and analytics.

Business changes: to support corporate transactions such as mergers, acquisitions, reorganizations, or asset transfers.

We may aggregate, de-identify, or anonymize personal information and use it for any purpose to the extent permitted by law.


3. Sharing of Personal Information

We may share personal information in the following circumstances:

Service providers and agents: with vendors and contractors who perform services on our behalf, including reservation management (Cubby Enterprises, Inc.), communications services (Twilio), website hosting and infrastructure providers, payment processors, analytics providers, marketing providers, digital advertising agencies that manage our paid advertising campaigns and may receive certain customer data to build advertising audiences and measure campaign performance, IT and security providers, and legal and professional advisors. These parties are subject to contractual obligations to protect the information and to use it only for FreeUp Storage's purposes.

Analytics and advertising partners: including Google Analytics, Google Ads, and Meta advertising tools (including Facebook and Instagram), for analytics and advertising measurement. See Section 4 and Section 9 for more information and opt-out options.

Business partners and referrals: with partners when you request or authorize a referral or when such sharing is reasonably necessary to complete a transaction or provide a service.

Business transfers: as part of, or during negotiations for, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.

Legal and compliance: when we believe disclosure is necessary or appropriate to comply with applicable law, regulation, legal process, or governmental request; to protect the rights, property, or safety of FreeUp Storage, our customers, or others; to detect, prevent, or address fraud, security, or technical issues; or to enforce our agreements and policies.

Emergency situations: if we reasonably believe that an emergency involving immediate danger of death or serious physical injury requires disclosure without delay.

With your direction or consent: where you instruct us to share your information or provide consent for a specific purpose.

We do not sell personal information for money. We may share certain online identifiers and usage data with advertising and analytics partners in ways that could be considered "sharing" or "targeted advertising" under certain state privacy laws. See Section 7 and Section 9 for your choices.

If you disable cookies, some features may not function properly.

Where required by applicable law, we provide mechanisms that allow users to manage cookie preferences and opt out of certain advertising-related cookies and tracking technologies.

Do Not Track: Our website currently does not respond to Do Not Track signals. We honor legally required browser-based Global Privacy Controls (GPC) for applicable jurisdictions.


7. Sale, Sharing, and Targeted Advertising

We do not sell personal information for money. We may share certain identifiers and online activity information with advertising and analytics partners (such as Google and Meta) for marketing and measurement purposes. This type of data sharing may be considered "sharing" or "targeted advertising" under certain state privacy laws, including California's Consumer Privacy Rights Act (CPRA) and the Colorado Privacy Act.

If you are a resident of a state with applicable privacy laws, you may have the right to opt out of this activity. Please see Section 9 for instructions on how to exercise your rights.


8. Online Security Measures and Data Protection

We implement administrative, technical, and physical safeguards designed to protect personal information against accidental, unlawful, or unauthorized access, destruction, loss, misuse, alteration, or disclosure. Measures include access controls, encryption in transit and at rest where feasible, network monitoring, secure development practices, employee training, and vendor due diligence. We conduct regular audits to help ensure the security of personal information.

No method of transmission or storage is fully secure; we cannot guarantee absolute security. In the event of a data breach,  we will provide notice to affected individuals, regulators, and other parties as required by applicable law.


9. Your Privacy Rights

Depending on your jurisdiction, you may have rights regarding your personal information, subject to applicable law. These may include:

Access: Request confirmation of whether we process your personal information and obtain a copy of such information.

Correction: Request that we correct inaccurate or incomplete personal information.

Deletion: Request deletion of personal information, subject to exceptions such as legal obligations, active account requirements, or fraud prevention.

Portability: Request a copy of certain information in a portable, commonly used format.

Opt out of targeted advertising or sharing: Object to or opt out of targeted advertising, sharing for cross-context behavioral advertising, and certain profiling. Automated Decision-Making and Profiling. We do not engage in automated decision-making or profiling that produces legal effects or similarly significant effects concerning individuals. Any profiling activities we conduct are limited to business analytics, customer communications, service preferences, marketing effectiveness, and related operational purposes.

Withdraw consent: Where processing is based on consent, withdraw it at any time.

Appeal: Appeal our decision if we decline to act on a request, where required by law.

Non-discrimination: You have the right to exercise any of the above rights without being discriminated against. We will not deny you services, charge you different prices, or provide a lower quality of service because you submitted a privacy request.

Exercising rights will not result in discriminatory treatment. We may need to verify your identity and place of residence to process requests and may deny certain requests as permitted by law. Authorized agents may submit requests on your behalf subject to verification.

How to Submit a Privacy Request: To submit a privacy request, please contact us using the information in Section 12 below, or submit a request through our online privacy request form at www.freeup-storage.com/privacy-request. We may need to verify your identity before processing your request. We will respond within 45 days of receipt. If we need additional time due to the complexity or volume of requests, we may extend this period by an additional 45 days and will notify you of the extension.

For opt-outs of targeted advertising or sharing, you may also enable Global Privacy Control  (GPC) signals in supported browsers. Where required by applicable law, we will process qualifying GPC signals as a valid request to opt out.

California Residents (CCPA/CPRA): In compliance with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), California residents have the right to know what personal information is collected, the right to delete personal information, the right to correct inaccurate personal information, the right to opt out of the sale or sharing of personal information, the right to limit use of sensitive personal information, and the right to non-discrimination for exercising these rights. California residents can submit requests via email or our online privacy request form.

Categories Collected: We have collected the categories described in Section 1 from the sources and for the purposes described in Sections 1 through 3.

Selling or sharing: We do not sell personal information for monetary consideration. We may share certain identifiers and online activity data with advertising and analytics partners as described in Section 7.

Sensitive personal information: We may collect limited sensitive personal information (such as government ID for identity verification).  We do not use or disclose sensitive personal information for purposes other than those permitted by applicable law, including California Civil Code Section 1798.121.

Notice of Financial Incentives: We do not offer financial incentive programs, loyalty programs, discounts, or other benefits in exchange for the collection, retention, sale, sharing, or use of personal information.

Retention: See Section 5.

Nevada Residents: We do not sell covered information as defined by Nevada law. You may submit a sale opt-out request to information@freeupstorage.com.

Colorado, Virginia, Connecticut, Utah, and Other U.S. States with Privacy Laws: You may have rights to access, correct, delete, obtain a copy of, and opt out of targeted advertising, sale, and profiling for decisions producing legal or similarly significant effects. Use the methods described above to exercise your rights. You may appeal a decision by contacting us at information@freeupstorage.com with "Privacy Appeal" in the subject line. Under the Colorado Privacy Act (C.R.S. 6-1-1301 et seq.), Colorado residents have 45 days from our response to submit an appeal. We will respond to appeals within 45 days.

EEA, UK, and Switzerland (if applicable): Legal bases: We process personal data based on consent, performance of a contract, legitimate interests (such as business operations, security, and marketing), and compliance with legal obligations. Additional rights: You may have rights to object to processing based on legitimate interests and to lodge a complaint with a supervisory authority in your country. Where required, we will enter into appropriate transfer mechanisms. See Section 10 for cross-border transfer information.


10. International Access and Data Transfers

FreeUp Storage, LLC is headquartered in the United States and our website can be accessed globally. If you access our services from outside the U.S., your information may be transferred to, stored, and processed in the U.S. and other countries that may have data protection laws different from those in your country.

Where required, we implement appropriate safeguards for cross-border transfers, such as standard contractual clauses approved by the European Commission, the UK International Data Transfer Agreement/Addendum, and other legally recognized transfer frameworks, along with supplementary measures where necessary to ensure an essentially equivalent level of protection.

Cross-border transfers may occur to our affiliates, service providers, and business partners that support our services. These parties are bound by contractual obligations to protect personal information and to process it only on our instructions and for specified purposes.

Where local law requires data localization or imposes specific conditions for international transfers, we comply with those requirements. Any onward transfer to a third party outside the original receiving country will occur only under a contract requiring at least the same level of protection.

11. Children's Privacy

Our services are not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13 in violation of the Children's Online Privacy Protection Act (COPPA), we will delete it promptly. If you believe a child has provided us information, please contact us using the details in Section 12.


12. Text and Phone Communications

Consent to Receive Communications

By providing your phone number to us, you are providing express written consent to receive communications from us at that number. We may contact you via:

- Text messages (SMS/MMS)

- Voice calls (including autodialed and prerecorded calls)

- Push notifications (if you have our mobile app)

Types of Communications

Transactional Communications (No Opt-Out Available): You will receive essential communications related to your storage account, including rental confirmations, payment receipts, account status updates, security alerts, past due notices, and emergency notifications.

Promotional Communications (Opt-In Required): With your separate consent, you may receive promotional messages including special offers, new service announcements, seasonal promotions, and referral programs.

Opt-Out Instructions

For Promotional Messages: Reply "STOP" to any promotional text message or email us at information@freeupstorage.com with the subject line "Unsubscribe."

For Transactional Messages: You cannot opt out of transactional messages while you maintain an active account with us, as these are necessary for account management and security.

Message and Data Rates: Standard message and data rates may apply based on your mobile carrier's plan. Contact your mobile provider for details.

Communication Service Providers: Text messages are sent through Twilio, a third-party communication service provider. By consenting to receive text messages, you acknowledge that your phone number and message content will be shared with Twilio to deliver communications, and that Twilio's own privacy policy and terms of service apply to their handling of your data.

Phone Call Recording: Phone calls to and from our facilities may be recorded for quality assurance, training purposes, and to maintain accurate records. A notification will be provided at the start of recorded calls. By continuing the call after the notification, you consent to recording. Our employees, contractors, and authorized third parties may listen to, transcribe, monitor, and archive recorded calls.


13. Policy Updates

We reserve the right to change and update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make material changes, we will post the updated Policy on our website and update the effective date above. We may also provide additional notice by email or prominent notice as required by law. Your continued use of our services after the effective date constitutes acceptance of the updated Policy.
